MINUTES OF DECEMBER 14, 2011 OIL BOARD OF DIRECTORS MEETING

OIL BOARD BUSINESS CONDUCTED BY DIRECTORS
Chairman Ron Donald convened the meeting at 10:05 am.
* The agenda was approved as amended
* The minutes of the November 7, 2011 meeting of the Board of Directors were approved as written.
* Treasurer Francis Thom submitted a financial report covering 11/07/2011 to 12/14/2011. The Board approved the financial report.

* Attempts of increasing membership of Older Iowans Legislature
* Following the November 7 meeting of the Board of Directors, the secretary sent email messages to former members of OIL and asked them to consider renewing their OIL memberships for 2012. Hard copy letters with the same request to renew memberships were sent to former members of OIL who do not have email.
* Neil Wubben reported that two additional new OIL members were recruited after he visited locations in the North and North Central Districts and promoted the Older Iowans Legislature.
* Bob Welsh suggested that the OIL email mailing lists be divided into "current members" and "non-members or friends". Bob then suggested that future legislative update reports sent to "Friends of the Older Iowans Legislature" could include an invitation to become a current member of the Older Iowans Legislature with submission of the $25 annual dues.

DISCUSSION OF UPCOMING IOWA GENERAL ASSEMBLY
* The Board of Directors welcomed Craig Patterson of Lobbying and Public Policy Consulting to the meeting and asked him to comment on the issues that he thinks will be considered and possibly enacted during the upcoming session of the Iowa General Assembly which convenes in January.
* The Board of Directors and Craig Patterson discussed at some length the ongoing process of restructuring the Area Agencies of Aging in Iowa.

DISCUSSION OF OIL PRIORITY BILLS
* Thanks to Bob Welsh for consulting with several outside experts in older adult health care during the past month in an effort to strengthen the OIL Priority Bills of 2011 before they are submitted to the 2012 Iowa General Assembly. The experts included representatives from the Department on Aging, Iowa Association of Area Agencies on Aging, AARP, Department of Inspections and Appeals, and Heritage.
* The OIL Board of Directors will be submitting bills to the Iowa General Assembly covering the following issues:
* Reimbursing the home and community based services waiver for the elderly on parity with skilled nursing facilities
* Funding for the Iowa Department on Aging and the Iowa Area Agencies on Aging
* Changing Iowa Administrative Code and Iowa Code to help ensure that the residents in assisted living facilities of Iowa receive quality care
* Expanding the long-term ombudsman program in Iowa to insure adequate staffing in Iowa's long-term care facilities
* Increasing the number of inspectors and staff positions in the Health Facilities Division of the Department of Inspections and Appeals
* At the December 14 meeting the OIL Board of Directors reviewed the comments and suggestions that Bob Welsh had received during the past month from outside experts concerning possible corrections and additions to the OIL Priority Bills. During the meeting the OIL Board members proposed several amendments to the bills. At the end of the meeting Bob Welsh volunteered to rewrite the bills with the suggested amendments and then to send the drafts by email to the other Board members for approval.
* Bob Welsh submitted a Plan of Action for presenting the OIL Priority Bills to the Iowa General Assembly in January 2012.
1. Agree on final wording of bills
2. Agree on fact sheet to go with each bill
3. Identify key legislators or friendly legislators for each bill and ask them to sponsor the bill
4. Send the bills to Governor and to various state departments requesting input and support for OIL bills. Also ask what bills they deem to be important so that OIL may join them as advocates.
5. Send bills and fact sheets to all OIL members with the request that they contact their legislators prior to the beginning of the session or the first week of the session.
6. OIL members will be updated on when the bills are introduced and on which committees and subcommittees of the Iowa General Assembly will be evaluating the bills.
7. When OIL bills have been assigned to committees and subcommittees of the Iowa General Assembly it is important that the Older Iowans Legislature immediately contact the legislators evaluating each bill and express support for the bill. The Older Iowans Legislature shall be available to testify for the OIL bills at the appropriate subcommittees and committees.
8. The Older Iowans Legislature shall send "Thank You!" emails at each step along the way.
9. The Older Iowans Legislature shall participate in the Lobby Day scheduled at the Iowa Capitol on Monday February 13, 2012.

The Board of Directors approved a motion by Bob Welsh to support Di Findley and the Direct Care Board of Professionals. Chair Ron Donald will send a letter of support.

Chairman Ron Donald adjourned the meeting at 1:55 pm.

* A survey completed by delegates at the September 26-27 Older Iowans Legislature session was reviewed.

* Respondents generally approved of starting the OIL session at noon of the Monday session allowing travel to Des Moines on Monday morning
* Respondents liked the idea of providing 37 cents per mile over 100 miles driven as travel compensation to the OIL session
* Respondents who stayed at the hotel on Monday night generally liked the "Dutch treat" dinner served at the hotel but they felt that the dinner should have started earlier than 7:00 pm.
* Several respondents wanted "younger" blood in the Older Iowans Legislature in order to get increased advocacy

Treasurer Francis Thom submitted a financial report covering 08/29/2011 to 11/07/2011 and a copy of the OIL Financial Journal covering 01/02/2011 to 11/03/2011. The Board of Directors approved the Treasurer's report.

The Board of Directors reviewed Ron Jome's log of travel and postage expenses for the Older Iowans Legislature starting on November 4, 2010 and ending September 30, 2011. The expenses reported during November 4, 2010 and September 30, 2011 totaled $1,707.10. A motion to request the Treasurer to pay Ron Jome $2,000 for Secretary Expense and Service was made, seconded, and approved by the Board of Directors.

Treasurer Francis Thom submitted a proposed Older Iowans Legislature budget for 2011-2012. The Board of Directors approved the OIL budget for 2011-2012.

The Board of Directors reviewed and edited the By-Laws of the Older Iowans Legislature as amended September 27, 2011. The amendment concerning At Large Delegates that was approved on September 27, 2011 was moved from Article II: Membership, Section 5 to Article VI: Organization as a second paragraph in Section 4, Session Delegates.

DISCUSSION OF OIL PRIORITY BILLS

At 11:30 am Chairman Ron Donald welcomed the four special guests to the Board of Directors meeting
* Mark Hanson, Iowa Association of Area Agencies on Aging
* Kimberly Murphy, Iowa Department on Aging
* Kent Sovern, AARP
* Anthony Carroll, AARP

The OIL Directors and the special guests met from 11:30 am until 1:40 pm discussing the Priority Bills of the 2011 Older Iowans Legislature and looking for areas of agreement and possible collaboration in an Advocacy Plan for 2012.

Older Iowans Legislature Priority Bills of 2011 that were reviewed and discussed:
* First Priority, OIL Bill 11-01, A bill for an act relating to reimbursement under the medical assistance home and community based services waiver for the elderly.
* After discussion it was felt that OIL Bill 11-01 might be strengthened with the addition of more data

* Second Priority, OIL Bill 11-29, A bill for an act related to funding for the Iowa Department on Aging in Iowa to provide critical support and advocacy for at risk and frail elders in Iowa.
* After discussion it was felt that OIL Bill 11-29 might be strengthened by coordinating and updating some of the numbers used in the bill

* Third Priority, OIL Bill 11-17, A bill for an act for the General Assembly to make changes in the Iowa Administrative Code and the Iowa Code that will help to insure quality care and to provide adequate resources to the Department of Inspections and Appeals.
* After discussion it was felt that perhaps OIL Bill 11-17 has too many issues; perhaps some of the issues in the bill should be separated

After discussing the OIL Priority Bills for almost two hours on November 7, the Board of Directors of the Older Iowans Legislature along with Kim Murphy (IDA), Mark Hanson, (i4a), Kent Sovern (AARP) and Anthony Carroll (AARP) decided to meet again sometime after December 10, 2011 to formulate collaborative Advocacy Plans for 2012. Between November 7 and the next meeting the representatives from IDA, AARP, and i4a will be formulating their advocacy plans and determining collaboration plans with the Older Iowans Legislature.

The next meeting of the Board of Directors of the Older Iowans Legislature will be on Wednesday December 14, 2011 at Aging Resources of Central Iowa starting at 10:00 am.

The special guests left the meeting at 1:50 pm after which time the Directors spent several minutes discussing options for advocating to the Iowa General Assembly when it convenes on January 9, 2012.

Chairman Ron Donald adjourned the meeting at 2:05 pm.

* Representatives to the 2011 Older Iowans Legislature met in the Iowa Capitol on Monday September 26 and Tuesday September 27, enacted sixteen (16) bills that focus especially on protecting frail elders, and then prioritized the enacted bills.
* The Older Iowans Legislature Representatives each voted for their top five priority bills and the votes were then tabulated and scored as:

* First Priority with 5 points
* Second Priority with 4 points
* Third Priority with 3 points
* Fourth Priority with 2 points
* Fifth Priority with 1 point

* The Priority Bills of 2011 are listed with their total points of priority. Also listed is the vote of ayes and nays for enactment.
* The top Older Iowans Legislature Priority bills will be submitted to the Iowa General Assembly prior to January 2012 with the request that they be introduced as Senate Files and House Files for debate in the 2012 session of the Iowa General Assembly.

PRIORITY #7 (with 31 points): OIL Bill 11-18 A bill for an act urging the Iowa Department on Aging to reactivate and to make provisions for the "substitute decision maker" program created by 231E of the Iowa Code, including budget provisions for such program.

PRIORITY #14 (with 9 points): OIL Bill 11-12 A bill for an act protecting the rights of grandparents and/or extended family when the Department of Human Services is involved in cases of abuse or neglect of minor children.

PRIORITY #15 (with 7 points): OIL Bill 11-30 A bill for an act to request the appropriate federal agency to allow the Department of Human Services to utilize the low monthly balance of bank accounts to determine resource eligibility of Medicaid applicants.

APPROVAL OF RESOLUTION SUPPORTING IOWA AGAINST ALZHEIMER'S MADE ON MONDAY SEPTEMBER 26, 2011

* "Be it resolved that the Older Iowans Legislature adopt this resolution supporting the Iowa Against Alzheimer's organization in their efforts to lobby and advocate that The State of Iowa and the United States government individually and jointly develop, enact and implement a Statewide and National Alzheimer's Plan with the goal of preventing or controlling this disease by 2020."
* "Therefore, as a immediate show of support the Older Iowans Legislature Board of Directors will sign an official copy of the approved resolution to be sent to Iowa Against Alzheimer's organization along with copies to be sent to the appropriate state and federal elected officials."

PROFESSIONAL OF THE YEAR AWARD, POSTHUMOUSLY, TO CYNTHIA BEAUMAN ON TUESDAY SEPTEMBER 27, 2011
* Mabel Mantel and Mike Otto of Northwest District presented the award of PROFESSIONAL OF THE YEAR TO CYNTHIA BEAUMAN to Cynthia's three daughters who came to the Capitol to accept.
* Cynthia Beauman, a good friend and supporter of the Older Iowans Legislature, died in January.

Old Business to be discussed
* Reviewed the effectiveness of the purchase of "alligator clips" printed with OLDER IOWANS LEGISLATURE that were placed on the desks of Senators and Representatives in January 2011 at the beginning of the session of the Iowa General Assembly. The "alligator clip" given to each legislator secured a small bundle of papers that described the Priority Bills of the 2010 Older Iowans Legislature. NOTE: Representatives to the 2011 Older Iowans Legislature session received the "alligator clips" on September 26, 2011.
* Leta Wall urged that future money be spent on more publicity for Older Iowans Legislature. Wall also urged that newspapers and news people who cover the lawmakers be contacted with information about the Older Iowans Legislature.
* Mike Otto reviewed the "letters to the editor" that had been distributed to Iowa newspapers prior to the session of the Iowa General Assembly.

New Business
* Amending Article XI AMENDMENTS of the By-Laws of the Older Iowans Legislature as amended May 31, 2006.
** Present wording: "These Bylaws may be altered, amended or repealed and new Bylaws may be adopted pursuant to Roberts Rules of Order on this subject."

Resolution of the Older Iowans Legislature, September 26-27 2011

Resolution: The State of Iowa and the United States government individually and jointly shall develop, enact and implement a Statewide and National Alzheimer's Plan with the goal of preventing or controlling this disease by 2020.

Whereas: Alzheimer's Disease is one of the leading causes of death in Iowa and the United States.

Whereas: Alzheimer's Disease will strike nearly 71,000 in Iowa and 5.4 million nationally by the year 2020 and triple that amount in the coming decades.

Whereas: The cost of caring for and treating people with Alzheimer's Disease will total nearly $2 billion in Iowa and $183 billion nationally in 2011 and will rise to $600 billion nationally by 2035 and a staggering $1.2 trillion by 2050.

Whereas: Today's current expenditure for finding a cure or effective treatment for this debilitating and fatal disease of less than one-quarter of one percent of the cost of treating its victims is totally unacceptable and must be increased to the point where we can optimistically anticipate a cure or effective treatment.

Whereas: Finding a cure for Alzheimer's will always be cheaper than treating its victims.

Whereas: Iowans and their fellow Americans are renowned for their intellect, perseverance and scientific skill so that there is no doubt if the necessary resources and equipment are provided, they will be successful in finding a cure or effective treatment.

Whereas: Promising research is emerging that may lead to a treatment and cure, but overall, lack of funding for Alzheimer's research is slowing the progress.

Therefore: Be it resolved that the Older Iowans Legislature adopt this resolution supporting the Iowa Against Alzheimer's organization in their efforts to lobby and advocate that The State of Iowa and the United States government individually and jointly develop, enact and implement a Statewide and National Alzheimer's Plan with the goal of preventing or controlling this disease by 2020.

Therefore: As an immediate show of support the Older Iowans Legislature Board of Directors will sign an official copy of the approved resolution to be sent to Iowan Against Alzheimer's organization along with copies to be sent to the appropriate state and federal elected officials.

The By-Laws of Older Iowans Legislature as amended May 31, 2006 in regards to amending said By-Laws states: "These By-Laws may be altered, amended or repealed and new By-Laws may be adopted pursuant to Roberts Rules of Order on this subject".

Whereas,

Article 68 of Roberts Rules of Order concerning Amendments of Constitution, By laws, and Rules of Order states: "Constitutions, By-Laws and rules of order that have been adopted and contain no rule for their amendment may be amended at any regular business meeting by a vote of the majority of the entire membership or if the amendment was submitted in writing at the previous regular business meeting, then they may be amended by a two-thirds vote of those voting, a quorum being present.

Chairman Ron Donald then introduced the following amendments to be considered at the annual meeting of the Older Iowans Legislature on Tuesday September 27, 2011.

Members and friends of the Older Iowans Legislature,

The 2011 Older Iowans Legislature (OIL) is scheduled for September 26-27 in the House Chamber of the Iowa State Capitol. According to the By-Laws of the Older Iowans Legislature (amended May 31, 2006), the Older Iowans Legislature is authorized to send 100 delegates from the nine OIL Districts to the legislative session in Des Moines.

As of today the delegates of record to the 2011 Older Iowans Legislature are listed below. The authorized number of delegates from each District is also listed below.

Delegates to the 2011 Older Iowans Legislature shall have the following qualifications:

Board of Directors reviewed an amended BOARD AND DELEGATE TRAVEL STATEMENT form submitted by Treasurer Francis Thom. The form provides for payment of the OIL membership dues for 2012.

Chairman Ron Donald and the Board of Directors reviewed the agreement with Secretary Ron Jome on annual compensation for expenses. Ron Jome is recording travel mileage between Ogden and Des Moines and is recording postage from Ogden.

* Neil Wubben-North District
* Neil has promoted Older Iowans Legislature at Elderbridge and has recruited new members. Neil reported that Elderbridge will be partially paying expenses for OIL delegates.

* Diane Naujokaitis-Southwest District
* Diane reported about David Saffeels, related to Tom Saffeels of South-Southeast District, who is an effective advocate but is a long distance truck driver and not always available for meetings.

* Bob Welsh-Southeast District
* Bob reported that Southeast District has appointed delegates for the 2011 Older Iowans Legislature. Southeast District has approved the proposed amendments to be discussed at the OIL annual meeting on September 27, 2011.

* Eileen Heiden-North Central District
* Eileen has talked with individuals in her area about Older Iowans Legislature. Eileen recently enrolled an OIL member in the Northeast District, namely Helene Magee from Dubuque. Eileen and Helene will be co-chairs of a standing OIL committee at the session on September 26, 2011.

* Harvey Martens-Central District
* Harvey said Central District may have 8 to 10 delegates at the Older Iowans Legislature on September 26-27, 2011.

* Mike Otto-Northwest District
* Mike anticipates a possible decrease in the number of OIL delegates from Northwest District because travel expenses to the annual sessions will not be paid by the Northwest area agency on aging.

* Francis Thom-South Southeast District
* Francis has been corresponding with potential delegates via email and snail mail and telephone. Francis reports that he may be the lone delegate from South-Southeast on September 26-27, 2011.

Planning for the 2011 Older Iowans Legislature session on September 26-27

* Chairman Ron Donald repeated his goal of having 75 delegates attend the 2011 Older Iowans Legislature. Ron asked the representatives present for a preliminary count of delegates coming to the 2011 OIL session:
* Northwest District: 3 delegates
* Central District: 8 delegates
* South-Southeast District: 1 delegate
* Southeast District: 20 delegates
* Southwest District: 2 delegates
* North District: 6 delegates
* North Central District: 3 delegates

* Chairman Ron Donald called for additional efforts to recruit delegates to the OIL session on September 26-27.

* Delegates shall reside in the District, delegates shall be 60 or older by September 26, 2011, delegates shall be 2011 OIL members by submitting the $25 membership dues to the OIL Treasurer no later than Monday September 12, 2011.

* Chairman Ron Donald reported on key note speaker options. Both Governor Branstad and Lt. Governor Reynolds are unavailable to address the 2011 Older Iowans Legislature. Board members made suggestions to invite certain department heads to be key note speakers. The departments included Aging, Inspections & Appeals, Human Services, Public Health, Insurance, SHIIP.

* Chairman Ron Donald asked for decisions on OIL awards to be presented at the 2011 Older Iowans Legislature.

* Maxine Henry Advocate of the Year Award: Board of Directors nominated Eve Casserly and Ron Jome to both receive the Maxine Henry Advocate of the Year Award for 2011.
* Professional of the Year: Board of Directors nominated Cynthia Beauman to receive a posthumous Professional of the Year Award for 2011.
* Legislator of the Year; Board of Directors did not make a nomination.

* Chairman Ron Donald called for nominations for co-chairs for the OIL standing committees and the informational caucuses that will meet on September 26, 2011. The Board of Directors made the following appointments:

The 2011 Older Iowans Legislature will convene on September 26 and 27 in the House Chamber of the Iowa State Capitol in Des Moines. Members and friends of the Older Iowans Legislature, the OIL Board of Directors wants to hear from you about possible bills you would like us to debate! We need you to write the WHAT, WHY, WHO, and HOW of the bill and we can put your ideas into our bill template.

BILL TEMPLATE INCLUDES THE FOLLOWING:

* BE IT ENACTED BY THE OLDER IOWANS LEGISLATURE (In as much description as needed, clearly explain the problem that needs to be corrected and your idea of how it can be corrected by action of the Iowa General Assembly in their 2012 session)

Board of Directors reviewed an OIL membership list dated July 21, 2011 that had been previously submitted by Treasurer Francis Thom.

* Chairperson Ron Donald asked the Board to review the list of OIL
members and to contact persons who have not yet renewed their membership for 2011 and to ask for renewed membership.
* Chairperson Ron Donald has a goal of seating 75 delegates in the
Older Iowans Legislature on September 26-27, 2011 and urged the Board to encourage prior OIL members to renew and to be delegates to the 2011 OIL session.
* The Board discussed the possibility of amending the By-Laws of the
Older Iowans Legislature to provide for AT-LARGE DELEGATES that might be seated to have a maximum of 100 delegates at the annual Older Iowans Legislature session in the House Chamber.

in the Elderbridge area agency on aging from Mason City to Denison. Neil has also made some contacts in Fayette County which is in Northeast OIL
District.

* Diane Naujokaitis-Southwest District

* Diane reported on contacts made with Kelly Butts at Southwest 8 area
agency on aging concerning recruiting new members of OIL.

* Bob Welsh-Southeast District

* Bob reported on actions of the Southeast District OIL meeting held
recently. The Southeast group had discussed priority bills for 2011 and had
discussed the election of delegates to the 2011 OIL session.

* Harvey Martens-Central District

* Harvey said Central District has a great potential for recruiting
new OIL membership but to date there has been little action in recruiting
and holding Central meetings. Harvey is focusing on the Polk County senior centers and the local AARP groups as potential sources of new OIL members. Harvey also reported that Jan Fackler, delegate to prior OIL sessions, had recently died.

* Mike Otto-Northwest District

* Mike reported on the change of leadership at Northwest area agency
on aging. Mike is currently working with the new director and discussing
possible new options of cooperation between the Northwest agency and the Older Iowans Legislture.

 

Discussion of new laws enacted by the 2011 Iowa General Assembly

* The law requesting the Department on Aging to submit plans for
reducing the number of area agencies to the Iowa General Assembly by
December 15, 2011 was discussed in depth. Neil Wubben presented information from previous meetings he attended.

 

Accepting advertisements in THE SENIOR OUTLOOK

* Chairperson Ron Donald had received an inquiry from an advocacy
group about the possibility of having advertisements printed in the THE
SENIOR OUTLOOK.
* Discussion and action by the Board:

* No paid advertisements will be accepted for THE SENIOR OUTLOOK.
* The advocacy group that made the inquiry will be contacted by
Chairperson Ron Donald. The advocacy group will be encouraged to join OIL as a Professional member with dues of $250. As a Professional member the advocacy group can then submit articles for submission to THE SENIOR OUTLOOK. These articles would then be subject to editorial control.

 

Reviewing, amending, and drafting new bills for the 2011 Older Iowans
Legislature:

* A packet of proposed drafts of bills for 2011 is currently under
review by the Board of Directors members and by a select group of other OIL members.
* Board members discussed amendments to bills in the packet and
discussed options for new bills yet to be drafted.
* The Board of Directors is requesting that the drafts of bills for
the 2011 Older Iowans Legislature be submitted to the Board by Monday August 29, 2011. Please submit the bill drafts to Ron Jome, Secretary, Board of Directors.
* The Board of Directors discussed the option of an OIL omnibus
appropriation bill that would then be one Priority Bill leaving options for
other Priority Bills that may not require an appropriation.

 

Options of collaboration of Older Iowans Legislature with other advocacy
groups

* Chairperson Ron Donald will send letters to certain Iowa government
offices and private advocacy groups asking for their issues of concern that
can possibly be incorporated into Older Iowans Legislature bills to be
debated on September 26-27, 2011 in the House Chamber of the Iowa Capitol.

 

Planning for the 2011 Older Iowans Legislature session on September 26-27

* Contacts are currently underway between OIL and the Chief Clerk of
the House, Charlie Smithson, for assignments of committee rooms and for use of the microphones and voting equipment at the Representatives' desks.
* Monday September 26

* Registration will start at 11:00 am in the House Chamber
* Session will convene at 12:00 noon
* Key note speaker: Governor Branstad or Lt. Governor Reynolds have
been invited but their calendars have not yet been confirmed.
* OIL committees will debate and possibly amend the bills before
approval. The bills may also be "killed" in committee and not brought to the
floor for debate on Tuesday.
* Evening meal event planned at the Holiday Inn

* Tuesday September 27

* The bills sent out by the committees on Monday will be debated on
the floor of the House. The bills will NOT be amended on the floor. OIL
members will vote on each of the bills presented.
* OIL members will vote for Priority Bills which will then be
submitted to the Iowa General Assembly in January 2012.

 

Planning for the 2011 OIL annual meeting on September 27

* Proposed amendments to the OIL By-Laws

* Reduction of age for membership from 60 to 50
* Allowing Professional members to have vote at OIL session
* Increasing the term of office from 1 year to 2 years
* Authorizing At-Large members to attend the OIL sessions

* Election of officers for 2012

 

Travel expenses

* Board of Directors reviewed a travel expense form for board members
and delegates to annual OIL sessions to record their mileage and to be
compensated at the rate of $0.37 a mile over 100 miles.
* The Board approved an amended travel expense form that allows the
OIL member to have his/her OIL annual membership of $25 paid from the travel expense.
* The Board approved paying Board members travel expenses to Board of
Directors meetings.

 

Suggested date and time of the next meeting of the Board of Directors of the Older Iowans Legislature is Monday August 29, 2011 at 5835 Grand Avenue in Des Moines starting a 10:00 am.

 

Chairman Ron Donald adjourned the July 25, 2011 meeting of the Board of
Directors of the Older Iowans Legislature at 2:00 pm.
